UPDATE: The Chattanooga Police Department has released the name of the victim in Sunday's shooting. 

CPD says the victim is 70-year-old Floyd Preston. 

PREVIOUS STORY: The Chattanooga Police Department has made an arrest in connection to Sunday's shooting. 

CPD says 68-year-old Marvin Lewis Preston is charged with Criminal Homicide for allegedly killing his brother. 

In an affidavit obtained by Channel 3, a neighbor says he saw a car pulling into the driveway of the victim's home. 

The witness says the car matched the description of Preston's car.

The witness says after seeing Preston pull into the driveway, he went to check on his dog. A few minutes later, he said he heard a loud "pop" sound. 

When he looked out his front door, Preston's vehicle was gone. 

The affidavit says police went to Preston's apartment on Monday.

When he was told about his brother's death, Preston said he doesn't trust his brother's neighbors. 

Investigators say they towed Preston's car, which was damaged in the front. 

The affidavit says a stop sign at the intersection of Dogwood Drive and Wilcox Boulevard had been damaged recently, and the damage to Preston's car matches the one to the stop sign. 

Preston is currently at the Hamilton County Jail and will appear in court on December 3rd.  

His bond is set at $1 million. 

PREVIOUS STORY: The Chattanooga Police Department responded to a shooting on Dogwood Drive Sunday evening. 

Police say when they arrived, they found a victim with a gunshot wound. 

They say the 70-year-old male victim was pronounced dead at the scene. 

His name hasn't been released yet.
