PREVIOUS STORY: An investigation is underway in Dalton after a man was shot by a police officer.

It happened around 9:00 Monday morning on Abutment Road and tied up traffic for several drivers.

The Dalton Police officer, who has not been named by investigators, is on leave as the investigation into the 45th officer-involved shooting in Georgia in 2019 is underway.

The man who was shot, identified as 32-year-old David Schmitt, is recovering at a hospital.

Gunshots interrupted the sound of commuters outside Sharon Burgess' home in Dalton.

"I heard those shots. POW! POW-POW!" she said, "I went in to get a cigarette and come back out and that's how quick it happened. I heard the three shots. So that's how quick it happened."

Moments later, a sea of flashing blue lights filled Abutment Road, one of the people involved, was a Dalton Police officer.

"When you hear shots fired, everyone dropped everything and ran out the door. And I know everyone that was out on the road immediately headed into this direction," Dalton Police Department Public Relations Specialist Bruce Frazier said.

Investigators said a handful of people called 9-1-1 reporting Schmitt walking in and out of traffic acting erratically. Burgess saw it too.

The way he was hunkered down, it looked like he was fixin' to sneak attack on the cop, you know what I mean," she added.

According to investigators with the Georgia Bureau of Investigation, Schmitt attacked the officer, causing the officer to fire his taser.

During the struggle, investigators said Schmitt took the officer's taser and was trying to use it on the officer.

As the officer was trying to get away, investigators said Schmitt continued to charge at the officer.

The officer fired his gun several times at Schmitt, hitting him.

After the GBI is finished with their investigation, they will turn their findings over to the district attorney.

It will be up to the district attorney to decide if the shooting is justified.

"You want an outside agency to investigate anything involving one of your officers and for us, that outside agency has always been the GBI," Frazier added.

Schmitt is in the hospital with non-life threatening injuries.

The officer received minor injuries from the struggle.
