UPDATE:  Police arrested Joshua Russell in connection to a kidnapping and home invasion case.

Saturday, Tyson Sylvester was taken into custody and charged, but Russell had left the scene by the time officers arrived, an arrest affidavit explained.

Officers took Russell into custody just before midnight at Cheddar's on Gunbarrel Road, where he was working, according to the affidavit. Channel 3 reached out to the eatery. They said his employment has since been terminated.

He was interviewed by officers and admitted that he was at the home in the 4000 block of Calderwood Circle with Sylvester when the incident happened. 

He explained that he left the home "after he determined how severe it was going," according to a police report. 

Russell was taken into custody and he faces charges of criminal conspiracy, kidnapping, burglary (occupied habitation) and harassment.

Saturday morning around 7:30, officers were called to the 4000 block of Calderwood Circle.

Police found the victim sitting in a vehicle with one of the suspects, Tyson Sylvester. Officers asked Sylvester to get out of the vehicle. He told officers that he was at the home to find the victim's daughter because she took his vehicle and money, according an arrest report.

The victim told officers that the wanted suspect, known as "Josh," and Sylvester, broke into her home and demanded she tell them where they could find her daughter.

She said she told "Josh" and Sylvester to leave, but they refused. "Josh" told her to "shut up and quit looking at him and that he had a gun," according to police.

The two men then began to ransack her home, and "Josh" fled the scene.

The victim said Sylvester demanded that she take him to her daughter. She said she told him that she had to go to work, but he refused to let her leave. Police said the victim told them that she was in fear for her life and felt he was going to hurt her, the report explained.

Police added that they were told both suspects are gang members.

Sylvester was taken into custody and charged with kidnapping, aggravated burglary (occupied habitation) and harassment.

"Josh" is described as a black man who is around 5'8" or 5'9". Officers say he has a thin build and was last seen wearing a gray hoodie closed over his face and red shoes.
