UPDATE: A Hamilton County family wants to know how their two-year-old daughter received head injuries while at her babysitter's home.

The incident happened in August on Vine Street in Soddy Daisy. the toddler died less than two weeks later. 

This week the Hamilton County Grand Jury indicted 27 year-old Benjamin Brown for the murder of Annie Burkett Shell. His girlfriend, Brandi Giannunzio, also faces charges connected to her death.

David and Tiffany Shell said they've been dropping off their two young children at Brandi’s home over the last five months. She was a longtime family friend, but the Shell's didn't know Benjamin Brown.

Annie was the center of her parents' world. They describe her as angelic, intelligent, and the perfect child. All of that was taken away from them the morning of August 9. 

The babysitter Brandi Giannunzio called 911, saying two-year-old Annie was having a seizure.

She was rushed to the hospital, where doctors told her parents the two-year-old's seizures were not natural. They were happening because she had blunt force trauma to the head. Twelve days later, Annie died at the hospital. 

The Shell family said it is still unclear what led to Annie’s head injuries.

A grand jury heard evidence in the case about a month after Annie’s death and chose to charge Benjamin Brown with felony murder and aggravated child abuse. 

The babysitter was also charged, for making false reports, and accessory after the fact, a charge that implies Brandi Giannunzio did not cooperate in the investigation against her boyfriend.

The day Annie got hurt, her little sister was also at the babysitter's home. Her parents said she received some bumps and bruises.

Both Giannunzio and Brown were arrested on September 27. They have since bonded out and are scheduled to be in court on Friday morning for an arraignment hearing.

ORIGINAL STORY: The Hamilton County Grand Jury has indicted a man in the death of a Hixson toddler in August of 2018.

According to court records, 27-year-old Benjamin Spencer Brown is charged with felony murder and aggravated child abuse in connection to the death of 2-year-old Annie Burkett.

Records say Brown "did unlawfully inflict mortal injuries on Annie Burkett during the perpetration of an aggravated child abuse, which resulted in the death of Annie Burkett on August 21, 2018."

According to Burkett's obituary, she would have turned 3 years old on August 28.

Brown was booked at the Hamilton County Jail on September 27. According to the jail's inmate list, Brown has been released.

Brown is scheduled to be in court for an arraignment hearing on October 5.
