House painter charged with sexual battery after incident with cleaning staff

HAMILTON COUNTY, TN (WRCB) -

A man was charged with sexual battery for inappropriately touching a woman while painting a house Monday.

According to the report, the victim told officers 35-year-old David Gallardo asked to take a picture of her backside and she said no. The victim says Gallardo then stuck his hand up her shirt and touched her breast after he grabbed her from behind.

The victim says she made several attempts to get away from Gallardo as he made inappropriate gestures to her backside and even tried climbing out of a window until Gallardo pulled her back inside, causing a cut to her knee.

The victim was eventually able to get away and called 911. She told deputies the suspect left the home in a white construction van.

The report says deputies stopped the van on Highway 153 and found Gallardo behind the wheel without a valid Tennessee drivers license.

He was arrested for sexual battery and driving without a license.

The report says Gallardo admitted to touching the woman by reaching over her shirt and asking to take the picture of her from behind, but claimed the two had been flirting with each other since they began working at the same home over the weekend.

Gallardo was booked in the Hamilton County Jail on a $12,000 bond.

He's scheduled to appear in court October 17.
