CHATTANOOGA, TN (WRCB) -

UPDATE: The homicide case against Jermichael Tillery was bound over to a grand jury Tuesday after a preliminary hearing before Judge Gary Starnes.

Tillery's attorney, Bill Speek, told Channel 3 his client will likely have a self-defense argument if it goes to trial.

"By the time we get all the witnesses here that we can get, I think it'll be a much clearer self defense case,' Speek said.

Tillery remains in the Hamilton County Jail.

Cornealius Douglas Sr. died of multiple gunshot wounds to his upper body, according to a preliminary report released by the Hamilton County Medical Examiner’s Office.

Police were called to 1418 Carousel Road around 1:00 on the morning of April 24.

An eyewitness told police he saw Douglas in an argument with Jermichael Tillery shortly before Tillery shot Douglas several times. Tillery was arrested and charged with Douglas’ murder.

Tillery, who denied being in an argument with Douglas or shooting him, is being held at the Hamilton County Jail on a $1 million bond. He’s due in court on May 10.

PREVIOUS STORY:   The arrest affidavit for suspect Jermichael Tillery in connection with the fatal shooting of Cornelius Douglas shows a slightly different chain of events in the early morning shooting Sunday.

An eyewitness told police he saw Jermichael Tillery and Cornelius Douglas in a verbal argument before the shooting.

The eyewitness described seeing Tillery fire 13 times at Douglas, with at least one shot striking Douglas.

Douglas returned fire, striking Tillery once.

Tillery told officers he was shot by an unknown party in a different location. He also denied being in an argument with Douglas.

He is being held on a $1 million bond. Tillery was on probation at the time of the crime and has other pending cases against him. He’s due in court on May 2 and has been assigned a public defender.

PREVIOUS STORY: Jimmy Allgood says he heard gunfire early Sunday morning.

“I was getting ready to go to bed, and then I heard one shot and then I heard five more. That’s when I jumped on the ground like everyone did in the house, and woke my uncle up,” said Allgood.

When Allgood went to see what was going on he saw 27-year-old Cornelius Douglas on the ground in front of this house on Carousel Road with a gunshot wound.

“I ran out and seen him lying over there, and I was like: "unreal." and I speak to this guy everyday too,” said Allgood.

Douglas passed away before police arrived.

Officers also found a second victim, 22-year-old Jermichael Tillery one block away suffering from a gunshot wound.

Police arrested Tillery and charged with criminal homicide and possession of a firearm. Police believe he is responsible for killing Douglas.

A makeshift memorial now sits on Carousel Road where the city's latest homicide of the year happened.

Family and friends describe Douglas as a father who loved his three sons.

“Every day he's like: "Hey Jimmy, how you doing? How you doing in your career? He was just a really good guy,” said Allgood.

Allgood doesn't want to see what happened to Douglas happen to others.

“They need to stop the violence and put away the guns. Simple as that! It was a tragedy,” said Allgood.

Police do not believe this shooting was gang related, as many of the city’s recent shootings have been.
