UPDATE: The Hamilton County Sheriff's Office has arrested Fay Sims for a third recent time, charging him with sexual battery.
The 85-year-old used car dealer is accused of putting his hand down the shirt of a female customer at his place of business on April 1, 2016.
The victim told police she went to the dealership to make a payment and was discussing trouble with a vehicle with Sims.
After the incident, she then walked out of the business according to the police report.
Sims' court date is set for April 18.
PREVIOUS STORY: A Chattanooga used car dealer is charged with sexual battery for a second time after allegedly forcing himself on a female customer.
Police arrested Fay Sims, 85, owner of Best Motors, after he allegedly told a female customer to pick up her car 30 minutes before his business opened. The alleged victim told police when she arrived Sims asked her what she would like to do to get her car back.
According to court documents he then pushed the woman against the wall, forced her to kiss him, put his hands in her shirt and attempted to put his hands in her pants.
During the assault, a customer came in and Sims reportedly stopped. He told police, “I did nothing”, when asked about the incident.
Sims is charged with sexual battery and being held at the Hamilton County Jail on a $10,000 bond.
This isn’t the first time Sims has been accused of sexual battery. He faced the same charge in December of 2014 when a woman claimed Sims rubbed her back and kissed her against her will. She told police Sims agreed to let her give him a lower payment than what she owed because he thought she was attractive. He’s due in Hamilton County Criminal Court on that charge next month.
