Judge sets trial date in hot-SUV death case for February

MARIETTA, Ga. (AP) - A judge has ruled that she won't try charges that a Georgia man accused in his son's death had inappropriate online exchanges with an underage girl separately from the death case.

A defense attorney argued Monday that allegations that Justin Ross Harris had sexually explicit exchanges with the underage girl are completely unrelated to the murder and child cruelty charges he faces. But Cobb County Superior Court Judge Mary Staley ruled against him, denying the request.

Police have said Harris left 22-month-old Cooper in an SUV on a hot day in June 2014. Harris faces multiple charges, including murder.

Harris' attorneys have said the death was a tragic accident.

Staley also says the trial in the case will begin the week of Feb. 22.
