Gang member's trial delayed as court awaits results from DNA evidence

A new settlement date has been set for a validated gang member accused of killing 33-year-old Warren Ransom and leaving his body on Hooker Road.

Marcus Birt, 33, is charged with felony murder and especially aggravated robbery. His attorney, Fisher Wise, told the court a piece of DNA evidence that was recently sent off to the TBI crime lab. Wise said the evidence will "change this case."

Prosecutors say they expect testing to be completed by next month.

Ransom died from a gunshot wound fired a close range, according to medical reports. 

Birt, a Mafia Insane Vice Lords gang member, is accused of killing Ransom reportedly during a robbery on March 1, 2014.

Birt's trial date has been re-scheduled a few times. 

A settlement in the case is tentatively set for July 23 in Hamilton County Judge Barry Steelman's courtroom.
