UPDATE: Man charged with criminal homicide for assault that killed unborn child

Posted: Updated:

UPDATE: Police say the attack happened along the 2200 block of East 3rd Avenue.

The 15-year-old victim told police she and Justin Armour, the father of her baby, were walking to the store when they started to argue.

She says Armour attacked her, repeatedly punching her. The teen was later taken to a local hospital, where she delivered the stillborn baby. Medical staff believes the assault led to the child's death.

“There have been charges against him for domestic violence, for the homicide of the fetus, for the violation of protective order, and we are currently investigating whether to file charges for statutory rape of a minor,” said Fred Fletcher, Chief of Police, Chattanooga Police Department.

The victim had an active protection order against Armour from a prior domestic assault. Channel 3 uncovered Armour's long history of domestic violence. He plead guilty to a domestic assault charge in April 2010, then again in January 2012, and again a year later. He served a suspended sentence and was back in court on the same charge in August of 2014. He was charged again in January of this year for assaulting the same teen he's accused of assaulting in this most recent case.

“This particular incident is exactly why we are focusing everything we can do, to prevent domestic violence, and to hold offenders accountable,” said Fletcher. Chief Fred Fletcher hopes this case will be prosecuted to the fullest, and says his investigators want justice for victims of domestic assault.

“Please report it we are committed to holding offenders accountable, and we want you to be and feel safe,” said Fletcher.

Justin Armour, who police confirm is a known gang member, is being held in the Hamilton County Jail on a $750,000 bond. He heads back to court on May 22.

The assault went on during the course of the day and into the night, according to police.

Twenty-three year-old Justin Armour has been charged with domestic assault.

Armour has a lengthy criminal record, with four previous domestic assault charges, amongst others.

The pregnant minor gave birth to a stillborn child later Wednesday night.

Medical staff told police that the baby had died as a result of trauma suffered during the assault.
