Teen charged with Tunnel Blvd. murder was out on bond for another murder
HAMILTON COUNTY, TN (WRCB) -
Channel 3 is learning more about the two teens accused of killing a man in his Tunnel Boulevard apartment, stealing his truck, and leading police on a wild chase.
Seventeen-year-old Javonte Davis and 19-year-old Gary Toney Jr. are both charged with felony murder.
Davis is already being charged as an adult in a separate murder case that took place in the same Tunnel Boulevard apartment complex, as the murder over the weekend.
Chattanooga's police chief says he is "offended" by the violence.
"These are things that I, my department, and this community will not tolerate," says Chief Fred Fletcher.
Police say after killing a man in his Shepherd Hills Apartment Saturday, 17-year-old Javonte Davis and 19-year-old Gary Toney Jr. stole the victim's truck.
A short time later, when an investigator spotted the truck, the two opened fire on the officer. He was not hit, but two bystanders on the street were struck by the bullets. They were not seriously injured.
"I think it does speak to the brazen criminality of these of people and how they were not to be caught by law enforcement, that they were willing to endanger anybody in the community and to commit felony assaults on police officers to try and escape custody," says Fletcher.
After crashing the truck, our camera was there as officers took Davis and Toney into custody.
It turns out, 17-year-old Davis is facing charges for another murder.
"I would say I'm more offended than frustrated," says Fletcher.
Channel 3 learned Davis was out on a $46,000 bond. He is accused of shooting and killing 24-year-old Kenny Hall in October 2014 at the same Tunnel Boulevard apartment complex.
A month before that, he was picked up on aggravated burglary and unlawful possession of a weapon charges.
"I don't think there's any reason to believe that they were connected to each other, other than the fact that they have the commonality of this one criminal," says Fletcher.
In the meantime, neighbors who knew the man killed Saturday, want the violence to stop.
"He would sit on my neighbor's porch over there and talk with her husband and he would throw up his hand and say, 'Hi.' He was just a nice man," says neighbor Norma Chapman.
A female juvenile was also in the truck with Davis and Toney. She has not been charged.
Davis and Toney are being held without bond. Fletcher confirms they are both known gang members.
Investigators have still not released the identity of the man who was killed, but neighbors tell Channel 3 he was in his 60's and lived alone.
