Pet company files suit against McKamey and others

CHATTANOOGA, TN (WRCB) - United Pet Supply claims its civil rights were violated when animals were seized from the pet company at Hamilton Place in 2010.

The company filed a federal lawsuit against Chattanooga, McKamey, and several of it's employees, including former director Karen Walsh.

Last year, the defendants appealed after a U. S. District Court judge ruled to allow the suit to proceed.

A recent ruling by the 6th Circuit says the defendants did not violate due process when they removed the animals because the animals were kept in poor conditions.  

The court did however rule seizing business records without a hearing was in violation of Due Process and the Fourth Amendment.  

The claims against the defendants will proceed.
