UPDATE: Victim ID'ed in fatal accident on I-75 in Ringgold

CATOOSA COUNTY, GA (WRCB) -

UPDATE: The Georgia State Patrol has identified the pedestrian that was fatally struck as James Medlen, 47, of Dalton.

EARLIER STORY: One man is dead after being hit and killed by a tractor trailer Thursday morning as he stood outside his broken down car.

The Georgia State Patrol confirms the accident happened around 4:05 a.m. on I-75 northbound.

Troopers say the man experienced car problems and pulled his Volkswagen Jetta off to the right lane of the interstate.

But a tractor trailer driver didn’t see the pedestrian who was standing in the right lane of the interstate outside his vehicle.

"He was wearing black clothes, black shirt, so the driver would not have seen the pedestrian in enough time to get out of the way,” said GSP Trooper Michael Best.

Trooper Best helped with the investigation and said the tractor trailer had just left the weigh station near MM143 and was northbound on I-75 and nearing Ringgold when the accident happened.

The driver was traveling 55mph at the time of the impact and swerved to avoid the man. He will not be charged in the pedestrian’s death.

"He's very shook up as to be expected,” Trooper Best said.

Now Sgt. Bill Case with the Georgia Department of Public Safety is using this accident as a teaching tool.

"If your car breaks down or you see you're having trouble, if you can make it to a safe spot such as an exit ramp, that's the safest place to be,” Sgt. Case said.  "Exit the vehicle. Stay between your car and away from the interstate, whether its woods or a field or whatever, stay away from the vehicle."

As for passing drivers, Sgt. Case said to be alert and move over to the next lane or slow down to a safe speed when passing broken down vehicles.

The far right lane of the interstate was closed for several hours Thursday as officials investigated the accident.
