Collegedale veteran sues neighbor and city over property dispute

FORT OGLETHORPE, GA (WRCB) - Vernon Herod lived in his home on University Drive in Collegedale for more than 50 years, but now it's vacant. He and his wife Roberta left their beloved city to get away from his neighbor and an ongoing battle over the property line.

"I was threatened by my next door neighbor," Herod explains.

He says the stress was beginning to affect his wife's health. "She had a lot of problems sleeping at night. She'd wake up screaming sometimes, 'lock the door, lock the door,'" Herod says with tears in his eyes. 

It all started after Herod allowed his neighbor, Tammie Crabtree, to build a turnaround driveway which overlapped his property by about two feet. However, over the years she built a shed and then a carport, each without the city's permission but the appeals board allowed it.

"I've never seen one where the city actively got involved in it, gave the green light and then knowing they made a mistake took no action on their part," Herod's attorney, Robin Flores says.

Since Channel 3's initial story the mayor dissolved the appeals board but the property line never moved. That's when Herod made the decision to sue the city and his neighbor.

"I've given her every opportunity that I could think of to amend this thing and make things right, but she's made no effort whatsoever," Herod says.
     
Crabtree was not home when we stopped by Tuesday afternoon.

Each one of Herod's new neighbors flies an American flag in honor of his service to his country, a sign of respect he says he never got in Collegedale.

"Its one of the worst things I've ever gone through," says Herod.

In the past Crabtree told Channel 3 she believed Herod just forgot where the property line was. Collegedale's city attorney says this is dispute between two neighbors, the city was unfortunately drawn into it and it should be resolved between the two neighbors.
