UPDATE: Charges officially dropped in road rage case

CHATTANOOGA, TN (WRCB) - UPDATE: The case against an accused road rage shooter has officially been dismissed. In December, Richard Manning was charged with criminal homicide and aggravated assault after police say he shot and killed a man. Days after the shooting, Manning suffered a stroke, complicating his health issues, and died last month. The victim's family is not happy about the dismissal.

Alex Gallman's family, silent until now, speaks about him and the tragedy of December 17th. "We are very disappointed this case will not be going to trial in order to lay this to rest for our son," said his mother Dianne Gallman.

Police say 62-year-old Richard Manning shot and killed the father of three in an apparent road rage incident. "We know our son and we also know what took place," the heartbroken mother continued.

Gallman's fiancée, Anna Caro, was with him in the car that fateful day. "December 17th marked our anniversary of our first date we had together and we were going to have lunch together to celebrate," she said. "In just a matter of seconds, my life and the life of our boys changed."

Manning was charged with criminal homicide and aggravated assault. Thursday, the case was dropped due to Manning's death from a stroke and other health problems. "This was a senseless act from someone that I pray no other Mother, Father, family, or children will ever have to face," Dianne Gallman said.

In the Thursday news conference, Gallman's family spoke of their faith. His father spoke of his love for Alex.

"Alex always said that I was his hero," he said, "but Alex was my hero."

Sister, Rashae Doyle, spoke of her relationship with a loving older brother whom she says was "the type of person who would diffuse a situation and turn the other cheek, always willing to help someone in need. Her feelings still raw, she added, "It's apparent to me that gun violence has become an epidemic in this country...I think there needs to be some change made to prevent these unnecessary acts and loss of innocent lives."

Caro, now a widow and single mother of three , spoke of how they will move forward. "He made my life complete," she said. "He is the love of my life and I'm trying to put all these pieces together for my boys."

A trust fund for the three boys has been set up at Suntrust Bank.

In December, Richard Manning was charged with criminal homicide and aggravated assault after police say he shot and killed 39-year-old Alex Gallman.

Days after the shooting, Manning suffered a stroke, complicating his health issues of cancer and diabetes.

 He died last month. Thursday, the victim's family said they were disappointed the case won't be brought to trial.

"This was a senseless act that took place," said Dianne Gallman, Victim's mother

The victim's family also thanked the community for their support and donations to the 'Alex Gallman' fund.
