Mims appears for the first time before Judge

WHITFIELD COUNTY, GA (WRCB) -

While many questions remain unanswered in this case, one thing is for sure, Skyy Mims is charged with murder.

"Skyy Raven Marie Mims, is that your name," said Magistrate Judge Chris Griffin.

Standing in shackles, with no expression on her face, Skyy Mims was read her charge.

"They have you for warrant on a felony for a charge of murder. That charge will have to be sent before the superior court for a bond hearing, ok," said Griffin.

Channel 3 spoke on the phone with Ringgold, Georgia attorney, McCracken Poston.

He says Georgia is one of the few states that doesn't classify murders by degrees.

"First degree being cold blooded killing, second being a reckless disregard for human life," said Poston. "Georgia just defines murder as an unlawful killing with malice forethought."

While the District Attorney's office says it's too early to know the possible sentencing, Channel 3 wanted to know what Mims could face if convicted.

Sentencing, Poston says, is decided case by case.

"It really depends on the seriousness of the surrounding circumstances. In Georgia you can get anything from life in prison to the death penalty," said Poston.

He says it's up to the prosecution to seek the death penalty but up to the jury to determine if it sticks.

"It has a lot to do with the victim actually with the heinousness and the suffering of the victim as to whether the death penalty would be justified," said Poston.    

Mims is set to appear in Superior Court at 9 a.m. on March 14th, the next step for Mims would be to go before the Grand Jury.
