His resignation was submitted July 26 and read simply "I would like you to consider this my resignation from the Cleveland Police Department."

His badge was returned and destroyed Monday.

He was put on leave last week after a woman filed a complaint saying Wooten sexually assaulted her at her home.

The Cleveland Police Department isn't saying if the alleged sexual assault happened while he was responding to a call, or the woman's age, just to say she is over 18.

The TBI's criminal investigation is ongoing.

This was the third similar allegation against him since joining the force in 2004. The TBI arrested him in 2006 on two counts of official misconduct. One charge was dismissed. He was acquitted on the other.
