Humane Society takes dogs back from family, claims contract violation

SOMERSET COUNTY, PA (WJAC) -- A Pennsylvania man is vowing to get his dogs back after the Humane Society of Somerset County took them back.

The Humane Society claims the family broke a contract it signed when it adopted the dogs.

Michael Gindlesperger's two dogs, Damon and Stefen, were taken while he wasn't at home.

"No warning, no phone call, no initial notice. There was nothing that anything was going to happen. They came in and took them when we weren't here," he said.

The Humane Society of Somerset County sent us this statement:

"This is the reason that every adopter is required to sign an adoption contract. The adoption contract states that all animals must be kept indoors have access to food and water. And have adequate shelter"

Part of the contract between Gindlesperger and the Humane Society states: indoor housing is required for all dogs and cats unless permission is granted for special circumstances.

The society says it received anonymous calls that the dogs were left outside in heat and rain with no food on more than one occasion.

Gindlesperger said he took care of the dogs, fed them, and only kept them outside because he and his family were getting ready to move.

He said nowhere in the contract does it state that the dogs must be left indoors for 24 hours.

"I don't have a lot of money. I can barely keep the light on in my house, but I am going to do everything in my power to pursue as much legal action as any court system will allow," Gindlesperger said.

The family says all of this could have been avoided with a simple phone call or warning. The Humane Society says it was just following protocol.

One dog has already been re-adopted; the other is being held at the Humane Society.
