Last minute appeal filed in McKamey lawsuit

CHATTANOOGA (WRCB) - A last minute appeal has delayed the case against McKamey Animal Center from going to trial.

McKamey lawyers believe their clients should be given qualified immunity, which protects government officials from being sued individually.

McKamey staff members are named as defendants in the case, along with the City of Chattanooga.

United Pet Supply claims its civil rights were violated when animals were seized from the pet company at Hamilton Place in 2010.

A judge previously ruled against immunity.

An appeal was filed Thursday .

The trial, which was scheduled to begin Monday, has been removed from the docket.
