EAST RIDGE, TN (WRCB) -- A 70 year old man is facing two counts of aggravated assault after an altercation at a Ringgold Road fast food restaurant that ended with him pointing a gun at employees.

According to police spokesman Erik Hopkins, East Ridge officers responded to the Wendy's on Ringgold Road this past Saturday afternoon around 4:00 p.m. on a disorder call.

When they arrived, the were told that Ernest Cummings, 70, had asked for another patron to be removed from the restaurant for "making too much noise". 

When management declined, they told officers that Cummings became angry and left the building. He then is alleged to have driven through the drive-thru where he shoved a tray of food and other garbage through the window and began to curse at employees.

He then is said to have produced a handgun from his vehicle and pointed it at two of the store employees before driving away.

East Ridge officers were able to detain him approximately two blocks from the scene where a .40cal handgun was recovered from the vehicle.

Cummings was transported to the Hamilton County Jail where he was charged with two counts of Aggravated Assault.

He is scheduled to appear in East Ridge Municipal Court on Tuesday, July 24th at 5:00 p.m.
