Disorderly conduct leads to assault on police officer

CHATTANOOGA (WRCB) - Two men are in custody following a disorder Thursday night.

One is charged for assaulting a police officer.

Officers were sent to Track 29 on Market Street where 43 year old Timothy Hicks was being belligerent and confrontational with security and patrons during a concert.

When officers went to get Hicks, his friend, 43 year old Richard Wetherbee blocked the way, grabbing Officer Daniel Cholota and refusing to let him by.

When Wetherbee refused to release the officer he was tasered.

While police were dealing with Wetherbee, Hicks punched Officer Sean Emmer in the face, attempted to gouge him in the eye and grabbed his service weapon.

A fight then started between Hicks and Officer Emmer.

A short time later, police were able to gain control of Hicks and take him into custody. Both Hicks and Officer Emmer were taken to a local hospital for treatment.

Hicks is charged with disorderly conduct, resisting arrest, public intoxication and aggravated assault on police. Richard Wetherbee was arrested for disorderly conduct and resisting arrest.
