Judge overturns decision evicting resident

CHATTANOOGA, Tenn. (AP) - A Hamilton County judge has ruled that a public housing resident cannot be evicted for drugs after calling police to report a visitor had them.

The Chattanooga Housing Authority had used its "one strike" policy to order Pamela Shumake out of her apartment at the College Hill Courts. Shumake had testified in a court hearing that she was away from her home when a man visited her husband. She called police and reported the visitor had marijuana.

A General Sessions Court judge ruled Shumake violated her lease agreement because criminal activity occurred in her apartment. She appealed to Circuit Court, where a judge ruled in her favor in an order filed June 30, according to the Chattanooga Times Free Press.
