SOUTH PITTSBURG, MARION COUNTY, TN (WRCB) -- Visually upset, Joe Duncan said he was thrown in jail for something he didn't do, which was assault.

Monday, he was trying to cut downed tree limbs from a power line outside his home when he stopped an EPB contractor in the middle of the road.

Soon after a jeep pulled up and the driver started yelling at them.

"I don't know if she was cussing at me, cussing at him, but she sure was a cussing," says Duncan.

Duncan said he asked the woman to calm down and leave, and eventually she did, only to have her husband return and run Duncan down in his front yard.

"I started burning rubber and came across the road and hit me. He knocked me into the fence and the mailbox," says Duncan.

He suffered several injuries: a bruised wrist, a bruised hip, and several scrapes. He now has to walk with a single crutch.

When police arrived they refused to take a statement saying everything happened on private property.

The neighbor drove off yelling obscenities.

"He yelled out 'You going to jail you SOB!' and then he burned rubber down the street," says Duncan.

The next day Duncan went to the South Pittsburgh Police office to file report,and waited several hours because no one was there.

We went there Thursday to talk with investigators, but ran into the same problems.

Once Duncan was able to talk with officers, he learned he was being charged with assault. The couple filed charges against Duncan earlier that day.

Duncan is charged with aggravated assault because he had the chainsaw in his hand when he was hit.

So far no charges have been filed against the neighbor.

Duncan's court date has not been set.
