CHATTANOOGA (WRCB) -- New DNA evidence has linked a man accused of raping and killing a four-year-old girl to the crime.

Paul Ware is serving a life-sentence for the 1994 crime.

He was the first person in the country to be tried using mitochondrial DNA.

Ware filed a post conviction petition, hoping two hairs found at the crime scene would cast doubt on his involvement in the murder.

After reviewing the results of the DNA testing, Hamilton County Criminal Court Judge Don Poole dismissed that petition. Ware also chose to withdraw it.
