CHATTANOOGA (WRCB) -- A Tennessee death row inmate has until next month to respond to a motion to re-set his execution date.
Edward Jerome Harbison was sentenced to death for the 1983 beating death, of an elderly woman in St. Elmo.
His execution was originally set for 2007, but Governor Bredesen placed a three month moratorium on executions. Then a federal judge ruled that lethal injection was unconstitutional. That ruling has been overturned.
The state has filed a motion to reset Harbison's execution date. Harbison has until September 7th to respond.
