CHATTANOOGA, TN (WRCB) -  After a tobacco trailer set up near a playground at Riverbend, the Hamilton County Health Department says it's raised a funk with them.

The Health Department says this letter is a follow up letter to a complaint dating back to December.

They claim the advertising violates a federal agreement from 1998 prohibits tobacco distribution in the presence of minors.

A Friends of the Festival spokesperson says they haven't violated any rules, in fact, say they have tightened their belts on the vendor.

Some festival-goers had mixed feeling about the advertising being so close to the playground.

While Health department officials say they will continue to raise awareness about the dangers of tobacco use.

The Friends of the Festival say they have no intentions of moving the trailer and say its proximity to the playground is mere circumstance.
