VA Court Considers TVA Pollution Dispute

RICHMOND, Va. (AP) - A federal appeals court in Virginia is considering an air pollution dispute between the Tennessee Valley Authority and the state of North Carolina.

The TVA is appealing a judge's ruling requiring an accelerated cleanup of coal-fired power plant emissions affecting air quality in North Carolina's scenic western mountains. A three-judge panel of the 4th U.S. Circuit Court of Appeals in Richmond heard arguments in the case Friday and is expected to rule in a few weeks.

U.S. District Judge Lacy Thornburg in Asheville, N.C., set a 2011 deadline for upgrading emission controls at three plants in east Tennessee and one in north Alabama. TVA already had planned the improvements but objected to the deadline, saying it would cost an additional $1 billion.
