CHATTANOOGA, (WRCB) A judge has dismissed the city's case against a mall pet store.
The Pet Company argued the case violated double jeopardy because City Judge Sherry Paty recused herself.
They also said the city had no jurisdiction over the Pet Company's business license, and a special judge agreed.
In June, officers with McKamey Animal Center raided the store and seized all the animals.
In the judge's ruling, the City of Chattanooga was ordered to pay court costs.
