SAVANNAH, Ga. (AP) - Deadlines set by a federal judge in the case of Troy Anthony Davis indicate it could be several months before the Georgia death row inmate gets a court hearing on his claims of innocence.
U.S. District Judge William T. Moore Jr. has given Georgia's attorney general until Oct. 10 to file a written response to an appeal by Davis' lawyers, who say new evidence proves he did not kill Savannah police officer Mark MacPhail in 1989. It likely pushes the case into late November.
He also asks the both sides Wednesday to stake out positions as to whether a "free-standing actual innocence claim" is recognized by federal law.
The U.S. Supreme Court on Aug. 17 ordered the federal court in Savannah to hear Davis' innocence claim.
